We also cannot guarantee that a vendor or buyer will consummate any sale and vendors and buyers both agree that this is a risk that they assume. You agree to release Princess Margaret Auction Website and its parent, subsidiaries, related and associated companies and their officers, directors, agents and employees from claims, demands and damages of every kind and nature arising out of or in any way connected with such disputes.
Restrictions: Any employees and representatives of the vendor of the item being bid upon, their immediate families and those with whom such employees and representatives are domiciled, may only bid on items not provided by Vendor.
Member Account, Password and Security: Upon registration, a user will receive a user ID and a password. Each member is entirely responsible for maintaining the confidentiality of his or her user ID and password. Furthermore, members are entirely responsible for any and all activities which occur under his or her user ID and password. Bidding and Buying: If you are the highest bidder in one of the online auctions or a buyer of one of the items available in our fixed price listings, you are obligated to complete the transaction with the vendor and to pay the cost of the item, together with all applicable taxes, shipping fees and any other fees associated with shipping and receiving of the item. You should also know that bidding on an item is an irrevocable offer to buy the item at the price bid and your confirmed bid can not be retracted.
LiveBid Auction items- Where an item has been specified as a LiveBid item- your bid is legally binding if you are the highest winning bidder after the live auction has completed. To be identified as a winning bidder you must be contacted by an auction consierge to confirm your winning status and collect payment. Payment sent in advance of this confirmation, or assuming winning bider status does not obligate us to provide you with the auction package.

Please note that a valid VISA, MasterCard or American Express credit card is required to purchase any item offered for sale on this site, both via the online auction and the fixed price format. Your credit card will be automatically billed if you are the highest bidder at auction close or if you are the purchaser of a fixed price item. For items over $9,999.00 payment must be made either by bank wire, or EFT. If a payment is made by a credit card a 2.9% credit card fee will be applied to the total. All successful bidders will receive a confirmation email from the appropriate vendor that outlines the transaction process. By providing your valid credit card information, you authorize Princess Margaret Auction Website and their partners to make a temporary charge to your credit card account, to verify that the credit card information you provide is valid. This charge will be refunded to your account within 30 days upon verification. This credit verification will occur each time you provide a different credit card. If a credit card is declined for any reason, Princess Margaret Auction Website, or the appropriate vendor, will attempt to contact the buyer via phone and/or email.
Bid Extend: The auto bid extend feature on this site works to ensure that bidders will always have a chance to challenge bids placed when an auction is about to close. When indicated on a listing page, if a bid is placed during the last 1 minute of an auction, the auction will be automatically extended for an additional 1 minutes from the time of the latest bid. The auction will close once all bidding activity has stopped for a period of 1 minutes. We reserve the right to extend this time beyond 1 minute.
Shipping Charges and Terms: The vendors set the shipping charges and terms of shipping and are responsible for shipping the purchased item. Buyers are responsible for any all shipping costs, tariffs, duties, customs or any other fees associated with the shipping and receiving of the item. This auction is being conducted on behalf of and at the direction of other parties. All parties involved are not responsible or liable for any errors, omissions or for any warranties or guarantees or for the fitness of use of a particular item either explicit or implied herein.
Your bid is a binding legal agreement that you will honor if you are the successful winning bidder. The winning bid includes any buyers premium or 'Fee's' as stated on the auction.
All bids are legally binding and enforced. Even if you are not the high bidder at the end of the auction your bid is still considered to be a legally binding purchase agreement at the highest registered bid amount placed by your account on the Site. In the rare event where the winning bidder defaults on payment, the second highest bidder will become legally bound to complete the transaction at their highest registered bid amount and will be notified within five (5) hours after the close of the auction to complete the transaction. Placing a bid and being outbid does not release you from your obligation or liability to complete the sale of this item. In the event where you are provided a second chance offer, whether you accept it or not you will be required to complete the transaction only at the highest bid amount placed by you. This will cause the Site, Clients and Auction Provider to incur significant costs, losses, damages and expenses. The minimum cost the Auction Provider, Donor and Client will incur from such actions is at least $15,000.00 CAD ('Stated Costs'). This cost represents the sellers marketing, advertising and expenses. Your actions may bring additional costs and or damages against the Seller which we will hold you liable for including but not limited to the cost of recovery, re-listing, re-marketing and or legal fees.
In the event where you place a bid you acknowledge and understand the you will be held liable for all costs and damages associated with cancelling a bid or non-payment and be liable to the Seller for the amount specified in Sec.8 for Stated Costs. The Seller may take additional legal action against you for fraudulent bidding activity to recover the entire final bid price in addition to cost associated with damages caused by fraudulent bidding which includes but is not limited to; administrative fees, legal fees and recovery costs. The Seller and the Auction Provider may provide all information to local authorities, credit bureaus and other reporting and collection agencies. The Seller and the Auction Provider and its partners reserve the right to seek remedies and damages to the fullest extent permitted by law against non paying bidders or any individual who compromises the integrity and good will of this auction event by placing fraudulent bids or any type of activity that may be viewed to be harmful and detrimental to the outcome of this auction.

If you fail to complete payment for an item you have bid on you authorize Vonality to charge or debit the amount due from your credit card on file including any shipping, handling or buyers premiums or persue collections efforts for the amount owing plus any administrative costs. Where we can not charge the full amount to your payment method on file, you agree to allow us to charge the maximum amount possible. In all cases the winning bidder may be subject to security checks and hereby consents as part of their participation to the reasonable examination of their persons and when requested may be subject to additional security procedures. All encounters may or may not be supervised by event staff and may be terminated at anytime without notice for any reason and no refund or claim may be made. Advance notice to any meeting will be provided and when available will be scheduled as far in advance as possible. The winning bidder acknowledges that due to the unique nature of these experiences it is sometimes difficult to anticipate and schedule exact meeting times. Therefore all participants must be available on standby during the entire duration of the experience for the meet-and-greet portion of the experience as any meeting may occur without notice and it is the winning bidder responsibility to ensure that they are available without delay. Resolution of Disputes: If a dispute arises between you and Vonality or Princess Margaret or the Donor our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, you agree that we will resolve any claim or controversy at law or equity that arises out of this Agreement or our services (a "Claim") in accordance with one of the subsections below or as we and you otherwise agree in writing. Before resorting to these alternatives, we strongly encourage you to first contact us directly to seek a resolution by going to the Contact Us help page. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
Law and Forum for Disputes: This Agreement shall be governed in all respects by the laws of the Province of Ontario as they apply to agreements entered into and to be performed entirely within Ontario between Ontario residents, without regard to conflict of law provisions. You agree that any claim or dispute you may have against Vonality must be resolved by a court located in Toronto, Canada, except as otherwise agreed by the parties or as described in the Arbitration Option paragraph below. You agree to submit to the personal jurisdiction of the courts located within Toronto, Canada for the purpose of litigating all such claims or disputes.
Arbitration Option: For any claim (excluding claims for injunctive or other equitable relief) where the total amount of the award sought is less than $10,000USD, the party requesting relief may elect to resolve the dispute in a cost effective manner through binding non-appearance-based arbitration. In the event a party elects arbitration, they shall initiate such arbitration through an established alternative dispute resolution ("ADR") provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
Improperly Filed Claims: All claims you bring against Vonality must be resolved in accordance with this Resolution of Disputes Section. All claims filed or brought contrary to the Resolution of Disputes Section shall be considered improperly filed. Should you file a claim contrary to the Resolution of Disputes Section, Vonality may recover attorneys' fees and costs up to $10,000USD, provided that Vonality has notified you in writing of the improperly filed claim, and you have failed to promptly withdraw the claim.
General:These terms of use shall be governed by and construed in accordance with the laws of the province of Ontario and the federal laws of Canada applicable therein. If any provision of these terms of use is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
